Why insurers make an offer in the first place

Insurance companies settle claims to close files and control costs — that's a normal part of their business, not necessarily a sign of bad faith. But it does mean their interest in a quick, low number and your interest in fair compensation aren't the same thing. The earlier an offer comes, the more likely it's based on incomplete information: treatment you haven't finished, symptoms that haven't fully resolved, or time off work that hasn't been fully counted yet.

Signs it may be too soon to decide

It's worth pausing before accepting if any of the following apply:

What accepting actually means

Settling a claim almost always involves signing a release — a document that gives up your right to seek any more money for that accident, even if your injury turns out to be worse than expected or new costs come up later. In nearly all cases, once it's signed, that's final; there's no going back to ask for more. This is separate from your no-fault accident benefits, which generally continue based on your ongoing needs — a settlement is usually about resolving a claim against the at-fault driver. Our guide on how much you can claim explains the two types of compensation and why it can be hard to know a fair number until your recovery is clearer.

Questions worth asking before you say yes

If you can't confidently answer these, that's usually a sign to slow down rather than sign.

A second opinion costs nothing

You don't need to decide alone. Most personal injury lawyers in Ontario offer a free consultation and work on contingency, meaning nothing upfront and no fee unless they recover more for you — so having someone review an offer before you sign rarely costs you anything. Our guide on whether you need a lawyer after a car accident walks through when it's worth making that call. And if you're worried that getting a second opinion will simply slow things down, our guide on how long a settlement typically takes covers what actually affects timing.
